Title: Reconsideration of the Prevention of Significant Deterioration and Nonattainment New Source Review (NSR) Project Aggregation 
Abstract:

In January 2009, the EPA issued a final rule that addressed when a source must combine (i.e., "aggregate") nominally separate physical and operational changes for the purpose of determining whether they are a single change and subject to review under the New Source Review (NSR) program. Following promulgation of the rule, the Natural Resources Defense Council (NRDC) submitted a petition for reconsideration as provided for in the Clean Air Act (CAA). The EPA responded to the petition by announcing the convening of a reconsideration proceeding and staying the effective date of the rule to allow time to conduct the reconsideration. This final reconsideration will address a range of legal and policy issues related to the 2009 Aggregation rule and complete any revisions of the rule that become necessary as a result of the reconsideration process.
