Abstract:
The U.S. Supreme Court remanded the MATS rule to the D.C. Circuit Court after finding that the EPA had not properly considered cost as part of the "Appropriate and Necessary" (A&N) Finding that was required under CAA section 112(n)(1)(A). The EPA will issue a notice that details how the Agency explicitly considered cost as part of the A&N Finding. |
