Title: ●Referral of Delinquent Claims to the Treasury Offset Program | |
Abstract:
Section 5 of the DATA Act, which amends 31 U.S.C. 3716(c)(6), requires Federal agencies to refer to the Treasury Offset Program (TOP) legally enforceable non-tax debts that are 120 days delinquent for administrative offset, instead of the previous 180 day delinquency requirement. Per the DATA Act all mention in the CFR of recipient claims that are delinquent for 180 or more days must be referred to TOP will be amended to reflect that recipient claims delinquent for 120 or more days must be referred to TOP. |
