Title: Revisions to the Export Administration Regulations to Adopt a Licensing Amendment Process and Other Licensing Process Efficiencies  
Abstract: This rule proposes revisions to the Export Administration Regulations (EAR) to adopt a licensing amendment process and to make other licensing process efficiencies. This rule proposes making changes to the EAR in parallel with changes to the Bureau of Industry and Security's online submission system for license applications to allow for licensees to request certain changes (amendments) to currently valid licenses. This rule also proposes additional changes to the EAR that are required to implement the licensing amendment process. Additionally, this rule proposes to remove the term "replacement license" from the EAR because, with the implementation of the changes proposed in this rule in final form, the term would no longer be needed. If the changes proposed in this rule are implemented in final form, all changes to licenses would fall into three clearly defined types of changes: changes that a licensee may determine are non-material based on specified EAR criteria and that do not require Bureau of Industry and Security (BIS) review (non-material changes); changes that a licensee may request through a license amendment request to BIS based on specified EAR criteria (license amendment eligible changes); and all other changes, which would require a new license (requires a new license changes). The changes proposed in this rule would significantly improve the efficiency of the BIS licensing system. These proposed changes would allow a more flexible licensing process that takes into account the increase in the standard validity period for BIS licenses [from two years to four years, as part of Export Control Reform (ECR)], and, therefore, the likelihood that there may be an increased need to make certain changes to licenses that warrant prior notification and BIS approval but do not warrant a new license.
