Title: ●Technical and Clarifying Edits to National Park Service Regulations Establishing Penalties, Mandating Blood Tests for Drunk Driving, and Prohibiting Mechanical Transport in Wilderness | |
Abstract:
This rule would make technical corrections to National Park Service regulations in 36 CFR parts 1 and 4 by: Deleting outdated penalty provisions to bring the regulations into conformity with new statutory authority in 54 USC 100751(c); and removing a blood test as one of the mandatory test options for operating a motor vehicle under the influence of alcohol to conform with two recent U.S. Supreme Court decisions that generally require a warrant for blood testing. In 36 CFR part 2, the rule would add a clarifying prohibition on using a wheeled device (e.g., a game cart) in established wilderness to section 2.20, "Skating, skateboards, and similar devices." |
