Title: Enforcement of Classified Information Security Requirements  
Abstract:

DOE is promulgating procedural rules for the assessment of civil penalties for classified information security violations. In accordance with section 234(b) of the Atomic Energy Act of 1954 as amended, DOE is authorized to levy civil penalties against DOE, including National Nuclear Security Administration (NNSA), contractors who violate requirements relating to the security of classified information. To date, DOE has implemented this regulatory authority through the enforcement of classified information security requirements established in regulations and Departmental directives, including DOE Orders, Manuals and NNSA Policy Letters, which are incorporated into prime contracts. The revisions would add significant clarity by identifying all applicable classified information security requirements as regulatory provisions under part 824. The regulatory amendments would also provide greater efficiency in the part 824 enforcement process by removing the administrative burden associated with reliance on numerous directives that are routinely updated with different versions applicable at contractor facilities based on the terms of the prime contract. Additionally, amendments would revise the procedural requirements of part 824 to be more consistent with DOE regulations at 10 CFR part 820 and 10 CFR part 851 governing the assessment of civil penalties for violations of nuclear safety and worker safety and health requirements, respectively.
