Title: ●TSCA Inventory Notification Active-Inactive Reporting Requirements | |
Abstract:
On June 22, 2016, President Obama signed into law the Frank R. Lautenberg Chemical Safety for the 21st Century Act which amends the Toxic Substance Control Act (TSCA), the Nation's primary chemicals management law. A summary of the new law, which includes much needed improvements to TSCA, is available at https://www.epa.gov/assessing-and-managing-chemicals-under-tsca/frank-r-lautenberg-chemical-safety-21st-century-act. This particular rulemaking effort involves the revised TSCA section 8, which requires the Agency to compile, keep current, and publish a list of each chemical substance that is manufactured or processed in the United States (i.e., the TSCA Inventory). Under amended TSCA section 8(b)(4)(A), EPA must promulgate a final rule within 1 year of enactment that would require manufacturers and, under certain circumstances, processors of chemical substances to notify the Agency of each chemical substance listed on the TSCA Inventory that the manufacturer (or processor, if applicable) has manufactured or processed for a nonexempt commercial purpose during the 10-year period prior to enactment. By statute, the notification deadline is 180 days after publication of the final rule in the Federal Register. |
