View Rule

This rule will implement the amendments made to the Freedom of Information Act (FOIA), 5 U.S.C. 552, as amended by the FOIA Improvement Act of 2016. The rule will supersede FHFA’s current FOIA regulation, located at 12 CFR part 1202. The rule will incorporate substantive and administrative changes set forth in the FOIA Improvement Act of 2016, guidance issued by the Department of Justice (DOJ) on Agency FOIA regulations, as well as reflect changes in FHFA’s administrative structure, and update several procedural provisions.

The FOIA Improvement Act of 2016 requires FHFA's Director, no later than 180 days after enactment, to review FHFA's regulations and "issue regulations on procedures for the disclosure of records under the FOIA in accordance with the amendments made by Section 2."  Agency FOIA regulations shall include procedures for engaging in dispute resolution through the FOIA Public Liaison or the Office of Government Information Services.
