Abstract:
This rule would clearly define the role of third-party arbitration in access authorization and fitness-for-duty determinations at certain nuclear facilities licensed by the NRC. This rule would seek to maintain effectiveness of access authorization and fitness-for-duty requirements, while ensuring a robust appeals process to preserve fairness to individuals who grieve the decision to terminate access authorization. It would consider legal, policy, technical, and cost-benefit analysis and inform the decisions regarding the preferred regulatory action. |
