Abstract:
Section 2(b) of the Transparency Act requires that the Office of Management and Budget (OMB) establish a single searchable database that provides the public, at no cost, information related to all Federal awards which are made to entities, including a unique identifier of the entity receiving the award and any other information OMB requires. In October 2010, OMB promulgated government-wide regulations at 2 CFR parts 25 and 170 that require entities applying for and receiving Federal financial assistance to have Dun and Bradstreet Universal Numbering Systems (DUNS) number and maintain active registration in Central Contractor Registry (CCR), succeeded by the System for Award Management (SAM). Since 2011, pursuant to OMB direction, NRCS has implemented OMB’s government-wide Transparency Act regulations, including cross-referencing these OMB regulations in NRCS conservation program regulations, policies, and conservation program agreements. NRCS customers have reported that these requirements are burdensome to their operations, and NRCS has expended Agency resources on implementing the provisions and addressing potential improper payments when such requirements cannot be fully met. Therefore, the purpose of this regulatory action is to relieve a requirement from farmers and ranchers and streamline program delivery by removing the DUNS/SAM requirements with respect to conservation program agreements which NRCS enters into directly with agricultural landowners and producers. In particular, the final rule will remove reference to 2 CFR parts 25 and 170 in the following NRCS program regulations:
