Title: ●Designation of Biobased Product Categories for Federal Procurement, Round 13 | |
Abstract:
Enactment of the Food, Conservation, and Energy Act of 2008 (Pub. L. 110-234) on January 3, 2008 provides the legal authority for this proposed rulemaking. Specifically, Section 9002(a)(3)(B)(iii) states that the BioPreferred Program (Program) guidelines shall "automatically designate items composed of intermediate ingredients and feedstocks designated under clause (ii), if the content of the designated intermediate ingredients and feedstocks exceeds 50 percent of the item (unless the Secretary determines a different composition percentage is appropriate)". This proposed rule will designate, for preferred procurement approximately 50 finished product categories including biodegradable foams, exterior paints and coatings, facial care products, paper products office paper, rugs and floor mats, safety equipment, and traffic and zone marking paints. In Round 11, the Program proposed the designation of several intermediate ingredient or feedstock product categories. The products that fit these intermediate product categories are typically used to manufacture finished products that may be grouped in the proposed finished product categories. Furthermore, there are currently United States Department of Agriculture (USDA) Certified Biobased Products that meet the definitions of these proposed finished product categories. Therefore, designating these product categories for preferred procurement would be an added benefit for the manufacturers of the USDA Certified Biobased Products and would bring the BioPreferred Program's two major initiatives more closely aligned in terms of the product categories recognized. |
