Title: ●Atlantic Highly Migratory Species; Rule to Create a Separate Regulatory Provision for Commercial Sale of Atlantic Highly Migratory Species by Charter/Headboat Vessels | |
Abstract:
This administrative action would allow Atlantic highly migratory species charter/headboats that do not sell their catch to obtain a highly migratory species Charter/Headboat permit without the commercial sale provision. Under current highly migratory species regulations, these vessels are permitted to sell their catch if they choose. Recent changes in United States Coast Guard commercial fishing vessel safety policies now classify vessels with this permit as commercial fishing vessels, since they may legally sell their catch. Safety requirements (including life rafts, emergency beacons, survival suits, etc.) for commercial fishing vessels may be overly burdensome for many highly migratory species Charter/Headboat operations. The action would create a separate regulatory provision for Charter/Headboat vessels to sell their highly migratory species catch. As a result, highly migratory species Charter/Headboat permitted vessels that do not sell, nor intend to sell, their highly migratory species catch could obtain the permit required to take fee-paying passengers, without subsequently being classified as a commercial fishing vessel under United States Coast Guard regulations. Charter/headboat vessels without the provision to sell highly migratory species would be subject United States Coast Guard safety regulations for uninspected passenger vessels of less than 100 gross tons and carrying six or less passengers. |
