Abstract:
A legal review of this part has determined that is entirely internal and should be repealed. Although there are statutes pertaining to child support and garnishment of wages, those statutes specifically require a court order. 32 CFR part 733 covers that limited scenario that precedes court order. This rule provides the commanders a tool to maintain good order in personnel matters under their cognizance, including affecting the pay and discipline record of members of the command. The Military Personnel Manual (MILPERSMAN) (for the Navy) and the Marine Corps Manual for Legal Administration (LEGADMINMAN) (for the Marine Corps) are used by commands as administrative tools to determine equitable support when there is no competent court order. 32 CFR 733 is simply internal policy, and it will be repealed. There are no cost savings associated with this rule. |
