Title: Delay or Amend Final Rule Amending Claims Procedure Regulation 
Abstract:

On December 19, 2016, the Department published a final rule amending 29 CFR 2560.503-1.  These amendments revised existing rules under section 503 of the Employee Retirement Income Security Act (ERISA) governing disability benefit claims and appeals under ERISA-covered plans (81 FR 92316).  The amendments were effective on January 18, 2017, but only to claims for disability benefits filed on or after January 1, 2018.  In an October 12, 2017, Notice of Proposed Rulemaking (82 FR 47409), the Department proposed to delay for 90 days the applicability date of the December 19, 2016, Final Rule (81 FR 92316). The Department also seeks public comment and data concerning regulatory alternatives in accordance with Executive Order 13777.
