Abstract:
The Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015, enacted November 2, 2015, as section 701 of the Bipartisan Budget Act, updates the process by which agencies adjust applicable civil monetary penalties for inflation to retain the deterrent effect of those penalties. Agencies were required to publish an annual inflation adjustment no later than January 15, 2017, and by January 15 of each subsequent year. The Inflation Adjustment Act provides that agencies shall adjust civil monetary penalties notwithstanding section 553 of the Administrative Procedure Act (APA). Additionally, the Inflation Adjustment Act provides a cost-of-living formula for adjustment of the civil penalties. This is the adjustment for 2018.
