Title: Civil Monetary Penalty Adjustments for Inflation | |
Abstract:
This rule amends U.S. Customs and Border Protection (CBP) regulations to adjust certain CBP civil monetary penalties for inflation in accordance with the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (2015 Act). Using the formula in the 2015 Act and guidance from the Office of Management and Budget (OMB), the Department of Homeland Security (DHS) calculated adjusted penalties and published an interim final rule on July 1, 2016, and a final rule on January 27, 2017, that adjusted DHS and DHS component civil monetary penalties for inflation. This rule adjusts for inflation several CBP civil monetary penalties that were inadvertently omitted from the DHS rules. |
