Title: Definition of Domiciliary Care 
Abstract:

The Department of Veterans Affairs (VA) proposes to amend its rule defining domiciliary care, to more accurately reflect the scope and breadth of services provided under this program. The Domiciliary Care Program in VA was initially established to provide shelter and a home-like environment to veterans who could not live independently but did not require admission to a nursing home. The program has evolved as the needs of our veteran population have changed. VA domiciliary care now also provides residential rehabilitation treatment for veterans with mental health or substance use disorders.  In addition, we propose to update our regulations so that they clearly authorize veterans to receive a temporary assignment of a 100% service-connected disability rating when admitted to domiciliary care as a result of a service-connected disability for a period in excess of 21 days. This is consistent with current practice, and clarifies that VA considers domiciliary care which is residential rehabilitation treatment to be "hospital treatment" when assigning a 100% service-connected disability rating when the admission is due service-connected disability for a period in excess of 21 days.
