Title: Brady Act Compliance and the National Instant Criminal Background Check Relief Program | |
Abstract:
Federal law prohibits certain Department of Veterans Affairs (VA) beneficiaries from owning firearms because mental disability precludes them from managing their monetary VA benefits. Under this law, VA must report information about these beneficiaries to the National Instant Criminal Background Check System (NICS), which is a Federal information system that those who sell firearms must review prior to completing commercial transactions. The law also requires VA to administer a program that allows affected beneficiaries to request that VA grant relief from the NICS reporting requirements. VA proposes to amend its regulations to prescribe the rules by which it will administer its relief program. |
