The Commission proposed guidance jointly with the Commodities Futures Trading Commission on certain electric power and natural gas contracts not considered to be swaps because they are customary commercial arrangements of the type described in "Further Definitions of 'Swap,' 'Security-Based Swap,' and 'Security-Based Swap Agreement';  Mixed Swaps; Security-Based Swap Agreement Recordkeeping," 77 FR 48207, 48246 (Aug. 13, 2012).
