Title: Transitional Compensation (TC) for Abused Dependents | |
Abstract:
This rule establishes policy, assigns responsibilities, and prescribes procedures governing the administration of transitional compensation (TC) for abused dependents. Transitional compensation is one of the many resources available to victims of domestic abuse. This program provides temporary monetary payments and military benefits to dependents of service members who have been separated from the military due to a domestic violence or child abuse offense. These benefits last from 12-36 months in accordance with the law. The intent of this benefit program is to encourage victims of domestic violence to come forward and report the abuse. It separates the victims from the abuser, informs the victims of the many resources available to them as a victim of domestic violence, ensures the safety and well-being of the victims, and ensures the Department of Defense does not leave a spouse and family financially destitute when the abusing spouse is discharged from the military for a dependent-abuse offense. In accordance with statute, the rate of payment varies based on the rank of the spouse, but is designed to cover living expenses such as food, clothing, and housing. The rule was last updated in 1995 and will be revised to reflect current practices and to remove internal content that is currently codified. |
