Title: Bond Exemption for Rights-of-Way on Indian Land | |
Abstract:
This rule would streamline the right-of-way process by eliminating the need for governmental entities to seek a waiver of the requirement to obtain a bond where they are prevented by law from doing so. Regulations finalized in 2015 established new requirements for bonding, insurance, or alternative security to cover the annual rental, estimated damages, operation and maintenance charges, and restoration, but allowed for a waiver of these requirements on a case-by-case basis. Some governmental entities are prohibited by law from providing bonding, insurance, or alternate security and must seek waivers. |
