Abstract:
The Department of the Interior has procedures to meet its trust obligation to probate Indian Estates. The Bureau of Indian Affairs (BIA) prepares a probate case file for an Office of Hearings and Appeals (OHA) judge, who makes heirship determinations and orders the Office of the Special Trustee (OST) to distribute property in accordance with the American Indian Probate Reform Act of 2004 (AIPRA). The proposed regulatory changes relate to efficiency and streamlining of processes, insuring that the Department meets its trust obligations, and helping achieve the AIPRA/statutory goal of reducing fractionalization of trust property interests.
