Abstract:
This rule would propose to amend the Department of Justice's regulations regarding motions to reopen and motions to reconsider where the respondent has left the United States. Rulemaking proceedings are being initiated in response to a petition for rulemaking from the American Immigration Council, titled "Petition for Rulemaking to Amend Regulations Governing Motions to Reopen and Reconsider Removal Proceedings for Noncitizens Who Depart the United States." By letter dated July 28, 2012, the Executive Office for Immigration Review partially granted the petition, committing to initiating a rulemaking proceeding to amend the departure bar regulatory provisions at 8 CFR sections 1003.2(d) and 1003.23(b)(1), without committing to any particular outcome for this rulemaking. |
