The CBP regulations at 19 CFR 14.4 pertain to the declaration, entry, and dutiable status of repair expenditures made abroad for certain vessels. Specifically, section 4.14 provides that when a vessel subject to the vessel repair statute first arrives into the United States or Puerto Rico following a foreign voyage, the owner, master, or authorized agent must submit a vessel repair declaration to CBP. The CBP port of arrival in turn must forward such a declaration to the Vessel Repair Unit (VRU). In addition, the owner, master or authorized agent/vessel operator must also file a vessel repair entry with the VRU. Under the current version of section 4.14, the owner, master, or authorized agent files the entry at  one of three VRU ports of entry (New York, NY; San Francisco, CA; and New Orleans, LA), based on the vessel’s port of arrival. However, owing to a steady decrease in the number of entries filed and, other factors, VRU operations have been consolidated to a single port of entry, New Orleans, LA. Therefore, in current practice, the vessel owner, master, or authorized agent/vessel operator files the vessel repair entry at the VRU in New Orleans. The regulation, as it stands, is therefore obsolete and creates confusion for both the agency’s operations and the regulated public, because it lists three VRUs when there is only one and potentially results in some declarations or entries going to the wrong location. The final rule will streamline CBP regulations to reflect this consolidation.
