Title: ●Migrant Education Program - Modification | |
Abstract:
We propose to modify seven subsections of the existing regulations for title I, part C-Migrant Education Program (MEP); 34 CFR 200.81(c), 200.87, 200.89(c). A majority of the proposed modifications are technical in nature-to update citation cross-references, and align to current terminology. We propose one substantive change to section 200.89(b), pertaining to requirements for prospective re-interviewing. We propose to modify the current requirement to only require independent prospective re-interviews within the first three years of the effective date of major statutory or regulatory changes which directly impact child eligibility, and would clarify acceptable re-interviews for annual prospective re-interviews. Identifying and addressing child eligibility errors are particularly critical given the direct relationship between counts of eligible migratory children and State allocations. The proposed modifications seek to reduce burden for State educational agencies (SEAs) while maintaining the integrity of eligible determinations. |
