Title: ●Incorporation of Existing Waivers Into Regulations 
Abstract:

This rulemaking would amend multiple regulations to incorporate existing waivers, or portions of those waivers, previously granted by FRA.  Waivers being considered for incorporation through this rulemaking address, for example, end of train device calibration requirements, duplicative or obsolete regulatory requirements under the Track Safety Standards, electronic brake valve waivers, certain roadway maintenance machine and roadway worker requirements subject to multiple 5-year waivers, and the use of Unit Condition Indicators for monitoring end-of-car cushioning units.  FRA believes that codifying the waivers under consideration would; (1) provide burden relief with the removal of the requirement to file for waivers and collect safety data on operations under the waiver; and (2) provide regulatory certainty, without compromising safety, based on the assessment of data collected during the time the waivers have been in effect.
