Title: Hazardous Materials: Adoption of Miscellaneous Petitions to Reduce Regulatory Burdens (RRTF) 
Abstract:

In response to various petitions for rulemaking submitted by the regulated community, PHMSA will amend the Hazardous Materials Regulations (HMR; 49 CFR parts 171 to 180) to reduce regulatory burdens while maintaining or enhancing the existing level of safety. These changes have been identified as deregulatory in nature and will provide a cost savings to industry. Specific examples include: in response to P-1666, this rulemaking action will revise 172.302(b)(2) for consistency with 172.326(a) and the International Maritime Dangerous Goods (IMDG) Code 5.3.2.0.2, to allow a minimum height of 12 mm (0.47 inches) for a proper shipping name marked on a portable tank that has a capacity of less than 3,000 L (792.52 gallons). Additionally, in response to P-1677, this rulemaking action will revise 173.5b to allow for the continued use of certain Portable and Mobile Refrigerator Systems thus providing significant regulatory relief to agricultural producers and related post-harvest precooling industry entities. Further, in response to P-1701, this rulemaking action will permit the import of filled pi marked foreign pressure receptacles for intermediate storage, transport to point of use, discharge, and export without further filling, as well as the import of certain pi marked foreign pressure receptacles for filling, intermediate storage, and export. Finally, PHMSA will amend the HMR and respond to other petitions that are identified as deregulatory in nature and which will provide a cost savings to industry.
