Title: ●Policies and Procedures for the Protection of Proprietary Rights in Technical Information Proposed for Release to Foreign Governments | |
Abstract:
This final rule will remove 32 CFR part 744 because it is duplicative of the overarching DoD rule concerning the international interchange for defense purposes of patent rights and technical information. Title 32 CFR part 264.4(d)(3) covers the international exchange of patent rights and technical information and grants authority to the "Secretary of the Military Department concerned, or his designee" to release technical information. The specific delegation to the Chief of Naval Operations, bureau and deputy bureau chiefs in part 744 is the only significant distinction between the two parts. However, such delegations are internal policy and do not require rulemaking. |
