Abstract:
DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement to implement section 816 of the National Defense Authorization Act for Fiscal Year 2019. If an agency needs to award a task- or delivery-order contract valued over $112 million to a single source, the head of that agency must first make a determination that the contract action meets one of the four criteria identified at 10 U.S.C. 2304a(d)(3). Section 816 amends the criteria at 10 U.S.C. 2304a(d)(3)(A) by requiring a determination that, when the task- or delivery-orders to be issued under the contract are so integrally related, the single source can efficiently perform the work. |
