Title: Reduction in Force; Performance-Based Reduction In Grade; Removal Actions; and Adverse Actions | |
Abstract:
The U.S. Office of Personnel Management (OPM) is aware of the judicially-imposed limitations on implementing Executive Order 13839, will comply fully with the injunction, and will not issue regulations implementing the enjoined aspects of the Executive Order as long as the judicial injunction is in place. OPM is proposing to revise its regulations governing reduction in force; performance based reduction in grade and removal actions; and adverse actions. The proposed rule is being revised to assist agencies in implementing those provisions of Executive Order (EO) 13839 (May 25, 2018) not subject to injunction. The proposed rule will also update references and language due to statutory changes, as well as streamline and clarify procedures and requirements to better support managers in addressing unacceptable performance and promoting employee accountability for performance based reduction in grade and removal actions as well as adverse actions. Finally, the proposed rule will support agencies in implementing their plans to maximize employee performance as required by Office of Management and Budget (OMB) M-17-22 (April 12, 2017) and elements of the President’s Management Agenda relating to the Workforce for the 21 st Century. In addition, this rule will contain proposed changes to reduction in force (RIF) procedures in accordance with the EO. Per the EO, OPM is proposing to prioritize performance over length of service when determining which employees will be retained in a RIF.
