The existing regulation established policy for determining Federal participation in covered flood control channels. The final rule action is largely administrative in nature, removing unnecessary and outdated CFR text which will provide clarity and reduce confusion to the public. The same content can be found in the Corps’ publication in the reference to Federal participation in flood projects as defined under ER 1165-2-21 and 33 CFR 238 Flood Damage Reduction Measures in Urban Areas. The rule does not place a burden on the public, therefore its repeal does not provide a burden reduction or cost savings. Although a portion of this is internal guidance for the U.S. Army Corps of Engineers, the ER 1165-2-21 guidance can be found online for the public at: https://www.publications.usace.army.mil/Portals/76/Publications/EngineerRegulations/ER_1165-2-21.pdf?ver=2013-09-08-233442-010. This removal supports a recommendation of the DoD Regulatory Reform Task Force.
