Title: ●Repeal of DFARS Provision "Award to Single Offeror" (DFARS Case 2019-D024) | |
Abstract:
DoD is issuing a final rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to repeal the provision at DFARS 252.237-7002, Award to Single Offeror. Included in solicitations for mortuary services, this provision notifies offerors that an award for all requisite services will be made to a single offeror and identifies the basis upon which award will be made. To maintain consistency and oversight, DoD policy requires the use of a requirements contract when acquiring mortuary services. The purpose of a requirements contract is to fulfill of all the needs of an activity for a specified period of time from a single contractor. Therefore, by the nature of a requirements contract, only one award can be made in response to a mortuary services solicitation and the disclosure of this information in the provision is redundant. Additionally, when a solicitation is issued, the contracting officer identifies the type of contract that will be awarded via FAR clause 52.216-1, Type of Contract, and includes information in the solicitation that identifies the basis upon which award will be made, along with all relevant evaluation factors. As such, the remaining information provided by this provision is already addressed elsewhere and this provision is no longer necessary. The repeal of this DFARS clause supports a recommendation from the DoD Regulatory Reform Task Force. |
