Abstract:
The DoD established part 211 by publishing an interim final rule in the Federal Register on October 20, 2011 (76 FR 65112), and a final rule in the Federal Register on December 5, 2013 (78 FR 73079-73376). Those rules were based on section 358 of the Ike Skelton National Defense Authorization Act for Fiscal Year 2011, Public Law 112-81. Section 358 was amended subsequent to its enactment, but part 211 was not changed. In the National Defense Authorization Act for Fiscal Year 2018, section 358 was repealed and replaced by 10 U.S.C. 183a. Section 183a was similar to section 358, but contained numerous changes. This rule provides details to the public as to how DoD will handle certain types of applications for new enery projects it receives for review from the Federal Aviation Administration (FAA) and from other types of entities. The purpose of this revision is to conform the rule to the recently enacted 10 U.S.C. 183a. In conforming the rule to the statute, DoD expects to convey the necessary, accurate information to the public as to how the Clearinghouse works on those matters it handles. The significant discretionary change not mirroring the statute is the inclusion of the chief executive officers of the commonwealths, the District of Columbia, and the organized territories along with the States for purposes of providing notices of presumed risk notices. |
