Title: Civil Monetary Penalties Law Notice of Proposed Rule Making 
Abstract:

The proposed regulation is a technical modification of 42 CFR 1003 and 1005 to align the express coverage provisions under which the Office of Inspector General exercises its authority to impose civil monetary penalties of that regulation with the provisions of the 21st Century Cures Act establishing HHS’s new civil monetary penalties authorities. The technical changes to this regulation specify that the CMPs for information blocking as well as grant and contract fraud enacted under the 21st Century Cures Act are subject to the same processes currently afforded parties in 42 CFR 1003 and 1005. The Cures Act references these procedures for imposing sanctions. However, the prior promulgation of these regulations, which specifically identify the statutes to which it applies, was made prior to the passage of the Cures Act.
