Title: Inapplicability of Additional Defense-Unique Laws and Certain Non-Statutory DFARS Clauses to Commercial Item Contracts (DFARS Case 2018-D074) 
Abstract:

DoD is issuing an advanced notice of proposed rulemaking to seek public comment on certain solicitation provisions and contract clauses contained in the Defense Federal Acquisition Regulation Supplement that are prescribed for use in contracts for commercial items or flow down to commercial subcontracts. The public comments received will be considered in the review of these commercial clauses in accordance with paragraphs (b) and (c) of section 849 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2018, as amended by section 837(a) of the NDAA for FY 2019.
