Abstract:
This request for information (RFI) relates to the definition of 'employer' in section 3(5) of the Employee Retirement Income Security Act of 1974, as amended (ERISA). The RFI mainly seeks comments on whether to amend 29 CFR 2510.3-55 to facilitate the sponsorship of "open MEPs" by persons acting indirectly in the interests of unrelated employers whose employees would receive benefits under such arrangements. The term "open MEP" in the RFI refers to a single defined contribution retirement plan that covers employees of multiple unrelated employers. |
