Title: Employment Authorization for Battered Spouses of Certain Nonimmigrants | |
Abstract:
The Violence Against Women and Department of Justice Reauthorization Act of 2005 created new employment authorization eligibility categories for certain nonimmigrant victims of battery or extreme cruelty. The Department of Homeland Security (DHS) proposes to amend its regulations governing the classes of aliens in the United States authorized to accept employment authorization to conform to these statutory updates. DHS also proposes to codify current policy, specifically the eligibility and filing requirements and adjudicative standard for certain abused spouses of nonimmigrants seeking employment authorization. The proposed regulatory amendments will provide eligible abused nonimmigrant populations with the information needed to properly file for employment authorization benefits. |
