Title: Amendments to the Regulation Governing Testimony of Agency Employees and Production of Agency Records and Information 
Abstract:

The U.S. Department of Energy (DOE) will propose to amend its "Touhy" regulations, which sets forth the procedures to be followed in the event of a demand for DOE records or testimony in a legal proceeding. The proposed revisions are intended to: (1) provide more helpful guidance to parties seeking to obtain information in the control of the DOE; (2) establish clear instructions for DOE employees faced with demands for DOE information; and (3) improve the decision-making process by disclosing the factors to be considered by the decision-maker and clarifying the procedure for authorizing the disclosure of information.
