Title: Conforming the Lead Disclosure Rule to Include Zero Bedroom Dwellings in the Definition of Target Housing and Making Other Clarifying Changes (FR-6053)  
Abstract:

This interim final rule updates HUD’s Lead Disclosure Rule (24 CFR part 35, subpart A), which covers the sale or lease of target housing, to reflect the expansion of the scope of that term by the Consolidated Appropriations Act, 2017 (Pub. L. 115-31, approved May 5, 2017) (the Act). The Lead Disclosure Rule (LDR) applies to all target housing regardless of whether it is federally owned or federally assisted and requires sellers and lessors to, among other things, disclose known lead-based paint and lead-based paint hazards and provide available records and reports. The currently codified LDR also provides purchasers and lessees a 10-day period to conduct risk assessments or inspections and attach specific disclosure and warning language to sales or leasing contracts prior to becoming obligated to the purchase contract or lease. The Act amended the definition of target housing, which generally included most pre-1978 housing, to include any pre-1978 zero-bedroom dwelling in which a child under age six (6) resides or is expected to reside. These dwellings had previously been exempted from the definition of target housing, and, thus, from the Lead Disclosure Rule. As a result, this rule conforms the definition of target housing to include zero-bedroom dwellings and clarifies certain terms and procedural requirements of the Lead Disclosure Rule.
