Title: Rules of Practice for Adjudicative Proceedings 
Abstract:

On May 12, 2015, the Commission voted to direct the Office of the General Counsel (OGC) to present for Commission consideration a revision of the Agency's Rules of Practice for Adjudicative Proceedings (Rules), 16 CFR part 1025. OGC drafted a notice of proposed rulemaking (NPRM), proposing to modernize the Rules to reflect changes in civil and administrative litigation since the Rules were adopted in 1980. OGC submitted the draft NPRM to the Commission on January 20, 2016. The Commission voted to approve the draft NPRM with changes, which was published in the Federal Register on April 13, 2016. Staff is reviewing the comments on the NPRM, and will submit a draft supplemental notice of proposed rulemaking (SNPRM) to the Commission in FY 2019. The SNPRM will address the comments on the previous NPRM, propose additional revisions reflecting the Commission's experience in recent adjudication, and consider procedures from adjudicatory rules in use at other Federal agencies.
