EEOC RIN: 3046-AA97 Publication ID: Fall 2019
Title: Revision of Federal Sector Regulation on Time Limits for Filing a Civil Action
Abstract:

This revision clarifies whether a complainant has exhausted administrative remedies, and thus has the right to file a civil action, even though the complainant has filed an appeal with the Equal Employment Opportunity Commission (EEOC), as discussed in Bullock v. Berrien, 688 F.3d 613 (9th Cir. 2012). On February 14, 2019, the Commission issued a Notice of Proposed Rulemaking (NPRM) (84 FR 4015) seeking comments on the issue.
