Title: Taking and Importing Marine Mammals; Taking Marine Mammals Incidental to the U.S. Navy Training and Testing Activities in the Mariana Islands Training and Testing Study Area 

Pursuant to Section 101(a)(5)(A) of the Marine Mammal Protection Act (16 U.S.C. 1361 et seq.) (MMPA), the National Marine Fisheries Service (NMFS), upon application from the U.S. Navy (Navy), is proposing regulations to govern the unintentional taking of marine mammals by harassment incidental to military readiness training and testing activities to be conducted in the Mariana Islands Training and Testing (MITT) Study Area. The proposed regulations would set forth the permissible methods of taking; other means of effecting the least practicable adverse impact on the affected species or stocks and their habitats (i.e., mitigation); and requirements pertaining to the monitoring and reporting of such taking over the course of seven years commencing in June 2020.  Letters of Authorization (LOAs) issued under the regulations would authorize the take of marine mammals incidental to the Navy's specified training and testing activities to be conducted within the MITT Study Area off the coasts of Guam and the Commonwealth of the Northern Mariana Islands, throughout the in-water areas around the Mariana Islands Range Complex (MIRC), the transit corridor between the MIRC and the Hawaii Range Complex, and at select pierside and harbor locations.
