Title: ●Construction of Water Resource Development Projects by non-Federal Interests | |
Abstract:
Section 204 of the Water Resources Development Act (WRDA) of 1986, as amended (33 U.S.C. 2232), was enacted to allow non-Federal interests to undertake construction of certain Federally authorized water resource development projects, with potential credit or reimbursement of the Federal share of that construction, subject to several requirements. Section 204 provides that prior to initiation of construction of the project or separable element, the Secretary must approve the plans and specifications and prior to such approval must determine that the project or separable element is feasible, i.e., technically feasible, economically justified, and environmentally acceptable. Further, Section 204 provides that construction is subject to any other conditions that the Secretary may require, and in particular for any conditions specified by the Secretary for construction of a water resources development project based on a feasibility study completed by the non-Federal interest under Section 203 of WRDA 1986, as amended (33 U.S.C. 2231). The proposed rule provides additional clarifications which will improve the effectiveness and efficiency of construction projects undertaken by non-Federal interests. |
