Title: Revision of Definition of Commercial Item (DFARS Case 2018-D066)
Abstract:

DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to partially implement sections 836 and 837 of the National Defense Authorization Act for Fiscal Year 2019. Section 836 separates the definition of commercial item into two definitions: one for commercial products and another for commercial services. The effective date of the new definition is January 1, 2020. Section 837 implements the new definition for commercial products in 10 U.S.C. 2533a, regarding the Berry amendment, and 10 U.S.C. 2533b, regarding specialty metals.
