Title: ●Rights Relating to Modular Open Systems Approaches and Validation of Proprietary Data Restrictions (DFARS Case 2019-D042) 
Abstract:

DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to implement paragraphs (a), (b), and (d) of section 809 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2017 and paragraph (b) of section 815 of the NDAA for FY 2012.  Paragraphs (a), (b), and (d) of section 809 address the restriction, by contractors and subcontractors, of DoD’s rights relating to items or processes developed exclusively at private expense, and the negotiation of rights relating to items or processes developed with a mix of Government and private funding.  Paragraph (b) of section 815 provides that DoD may not challenge a contractor’s proprietary data restrictions more than 6 years after the date of final payment on the contract or delivery of the technical data.
