Abstract:

DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement to implement section 816 of the National Defense Authorization Act of Fiscal Year 2020. Section 816 amends 10 U.S.C. 2304a to permit DoD to award a task or delivery order contract with an estimated value exceeding $112 million to a single source without the written determination required by 10 U.S.C. 2304a(d)(3), if the head of the agency has executed a justification for other than full and open competition under Federal Acquisition Regulation part 6.
