This final rule will remove the Department of Defense’s (DoD’s) duplicative regulation concerning the Sexual Assault Prevention and Response Program (SAPR) Procedures. DoD will publish a single revised DoD-level SAPR Program rule at 32 CFR part 103, which will finalize two previously published interim final rules. The revision of 32 CFR part 103 will delete all guidance internal to DoD, and incorporate from 32 CFR part 105 only those policy provisions directly affecting DoD's obligations to provide sexual assault prevention and response (SAPR) services to certain members of the public who are adult victims of sexual assault. Therefore, part 105 is now unnecessary and will be removed from the CFR after the revision of 32 CFR part 103 publishes in the Federal Register. The removal of 32 CFR part 105 supports a recommendation of the DoD Regulatory Reform Task Force.
