Title: Importations of Pesticides and Pesticidal Devices | |
Abstract:
This document proposes amendments to the U.S. Customs and Border Protection (CBP) regulations pertaining to the importation of pesticides and pesticidal devices into the United States subject to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). An importer or his customs broker seeking to import pesticides and devices into the United States must demonstrate compliance with the FIFRA by submitting certain information on a Notice of Arrival of Pesticides and Devices (NOA) to the U.S. Environmental Protection Agency (EPA) prior to arrival and to CBP at the time of entry. CBP, in consultation with EPA, is proposing amendments to the CBP regulations to enhance administration of the pesticide and device import program under the FIFRA. Specifically, CBP proposes to clarify the circumstances under which the NOA must be filed, codify the existing required NOA data elements, require the submission of additional NOA data elements for unregistered pesticides that are currently optional, and permit the electronic filing of the NOA in the Automated Commercial Environment (ACE) or any other CBP-authorized electronic data interface system. These proposed changes would assist EPA and CBP in fulfilling their statutory obligations under the FIFRA to regulate the importation, distribution, or sale of pesticides and devices in the United States, support key modernization initiatives, expedite the entry and clearance process, enhance targeting and enforcement objectives, and connect partner government agencies and the trade community through a single window access point. This document also proposes non-substantive editorial changes to the CBP regulations. |
