Title: ●Energy Conservation Program for Appliance Standards: Procedures for Evaluating Statutory Factors for Use in New or Revised Energy Conservation Standards 
Abstract:

The U.S. Department of Energy (DOE) is considering revisions to its regulations at 10 CFR part 430, subpart C, appendix A (the Process Rule). The revisions would clarify how DOE considers consumer impacts in determining whether a standard is economically justified. The revisions would clarify that the requirement to determine economic justification based on comparisons across the full range of trial standard levels that DOE considers is consistent with the Energy Policy and Conservation Act. DOE initially addressed this issue in the Notice of Proposed Rule (NPRM) to the recently published revised Process Rule that can be found at 84 FR 3910 (February 13, 2019). As a result of comments from stakeholders in this latter NPRM, DOE issued a separate SNOPR specifically addressing the issue that is the subject of this rulemaking so that it could get further comment from stakeholders. DOE finalized the remainder of the modernized Process Rule at 85 FR 8626 (February 14, 2020).
