Title: NESHAP: Surface Coating of Automobiles/Light-Duty Trucks; Miscellaneous Metal Parts; Plastic Parts; Large Appliances; Metal Furniture; and Fabric Printing Residual Risk and Technology Review | |
Abstract:
This action addresses the agency's residual risk and technology review (RTR) for three National Emission Standards for Hazardous Air Pollutants (NESHAP): for Surface Coating of Automobiles and Light-Duty Trucks (ALDT); for Surface Coating of Plastic Parts and Products; and for the Surface Coating of Miscellaneous Metal Parts and Products. These NESHAPs were promulgated pursuant to section 112(d) of the Clean Air Act (CAA) and established emission limitations and work practice requirements based on maximum achievable control technology (MACT) for controlling emissions of hazardous air pollutants (HAP) from new, reconstructed or existing affected sources. The ALDT NESHAP, subpart IIII, was promulgated on April 6, 2004 and affects sources located at facilities that apply topcoat to new automobile or new light-duty truck bodies or body parts for new automobiles or new light-duty trucks. Ninety-five percent of the source category emissions include xylenes, methyl isobutyl ketone, ethyl benzene, cumene, toluene, methanol, glycol ethers and naphthalene. The Surface Coating of Plastic Parts and Products NESHAP, subpart PPPP, was promulgated on April 19, 2004 and affects sources located at facilities that apply coatings to plastic parts and products. Plastic parts and products include plastic components of the following types of products as well as the products themselves: motor vehicle parts and accessories for automobiles, trucks, recreational vehicles; sporting and recreational goods; toys; business machines; laboratory and medical equipment; and household and other consumer products. The primary Hazardous Air Pollutants (HAP) emitted from this category include xylenes, toluene, methyl isobutyl ketone, ethylbenzene, styrene, glycol ethers, methanol, methyl methacrylate, cumene, hexane, formaldehyde and naphthalene. The Surface Coating of Miscellaneous Metal Parts and Products NESHAP, subpart MMMM, was promulgated on January 2, 2004 and affects sources located at facilities that apply coatings to miscellaneous metal parts and products. Miscellaneous metal parts and products include metal components of the following types of products as well as the products themselves: motor vehicle parts and accessories, bicycles and sporting goods, recreational vehicles, extruded aluminum structural components, railroad cars, heavy duty trucks, medical equipment, lawn and garden equipment, electronic equipment, magnet wire, steel drums, industrial machinery, metal pipes, and numerous other industrial, household and consumer products. The primary HAP emitted from this category include xylenes, toluene, methyl isobutyl ketone, ethylbenzene, styrene, glycol ethers, methanol, methyl methacrylate, cumene, hexane, formaldehyde and naphthalene. This rule implemented the residual risk review requirements of CAA section 112(f)(2) and the technology review requirements of CAA section 112(d)(6) for the three source categories discussed above. CAA 112(f)(2)) directs EPA to revise the NESHAP if such revisions are required to provide an ample margin of safety to protect public health or to prevent, taking relevant factors into account, an adverse environmental effect. CAA section 112(d)(6) requires the EPA to review and revise the MACT standards as necessary, taking into account developments in practices, processes and control technologies, no less often than every 8 years. Pursuant to a court order (California Communities Against Toxics v. Pruitt, Case No: 1:15-cv-00512 (D.D.C.)), the EPA was obligated to complete the final action on the residual risk review requirements and the technology review by March 13, 2020. In addition, we made technical corrections to the rule text for Large Appliances; Metal Furniture; and Fabric Printing as part of this action. |
